Ignored and Underfunded, Mental Health Care Thin at County Jails ...

For more than a decade, Milwaukee County?s jail system has been under the scrutiny of a court-appointed medical monitor for its failure to provide adequate health care, including for inmates with mental illness.

In August, the monitor found mental health care in Milwaukee County?s two jails was still in shambles. Among the problems: Vacancies in top medical positions left jailers to make medical decisions, such as when an inmate should be removed from suicide watch. A man who had threatened to kill himself stopped eating and drinking for four days and was never taken to a hospital. He died in his cell.

Mental health advocates and correctional officials agree that Wisconsin?s 72 county-run jails are strapped for resources and not prepared to deal with the large numbers of inmates with mental illness they house. The state Department of Corrections (DOC) is charged with oversight of jails, but the agency?s inspectors are not physicians and, the agency said, not responsible for assessing the quality of health care.

The DOC inspection checklist includes whether the facilities keep adequate records, have the correct staff and keep medications secure. In Milwaukee County, for example, the two jails? most recent DOC inspections last December give no hint of the problems identified by Dr. Ronald Shansky, the court-appointed physician.

Again and again, inspector Gregory Bucholtz marked an X for ?meets approval? for each health-care standard, concluding that at Milwaukee County Correctional Facility-South, ?Health care services at the facility continue to be good ? Mental health services also remain good.?

Shansky?s take, in an inspection days before that DOC visit, was radically different. He found systemic problems in several areas, including record keeping, delayed access to medical services and medications, and ?severely mentally ill patients being inappropriately placed in disciplinary cells.?

Just five counties? jails ??Waukesha, Washington, Walworth, Fond du Lac and Dane ??are accredited by the National Commission on Correctional Health Care, which uses health-care professionals to assess the quality of care at facilities.

More information needed

Rep. Garey Bies, R-Sister Bay, who chairs the Assembly Committee on Criminal Justice and Corrections, said he plans to ask the DOC to present information to his committee on how well jails are caring for their inmates.

As a former chief deputy sheriff, Bies used to oversee the Door County Jail. He said he is particularly interested in ensuring inmates are screened for mental health problems, which he said is crucial to providing proper care, helping them transition back into the community and avoiding crises that could arise while they?re incarcerated.

?Do that (screening) up front, and it really cuts down on issues in the long run,? Bies said.

In a 2009 DOC survey, less than half of the county jails that responded had a registered nurse or mental health professional doing the initial health screening of inmates; correctional officers did it in most jails.

The DOC makes preannounced inspections of county jails annually, and investigates after suicides and other incidents.

?We mitigate risk by providing technical assistance and training, based on best correctional practice,? said Kristi Dietz, director of the DOC?s Office of Detention Facilities. The agency provides verbal or written feedback after inspections, but it doesn?t punish jails with sanctions.

Lawsuits are frequently cited as an incentive for jails to improve.

But ?you can?t count on lawsuits to expose these types of problems,? according to Larry Dupuis, legal director of the American Civil Liberties Union of Wisconsin, which sued Milwaukee County over its lack of jail health care services.

Ron Honberg, policy and legal director for the nonprofit National Alliance on Mental Illness (NAMI), said county jails nationwide have a ?long, long way to go? in providing adequate mental health care.

Honberg ticked off the problems: ?Lack of oversight, lack of treatment resources, lack of expertise, lack of qualified staff, overcrowded conditions.?

More need, less attention

Dietz said communities are falling short at helping people with mental illnesses, ?and as a result the jails and prisons, unfortunately, have been taking on more and more of that population.?

A national study estimated the one in three female inmates and nearly one in six males suffers from mental illness ??far higher than the general population estimate of 6 percent. Even after a substantial drop from 1990 to 2010, the national jail suicide rate is still three times greater than in the general population.

Jail officials and advocates statewide have been seeing more inmates with mental illness in recent years, although no specific estimates are available.

The problems in jails are often overshadowed by those in prisons. But mental health needs may actually be greater at these facilities, where inmates face uncertain fates, more stress and fewer services.

And jails aren?t only for short-term detention ? some inmates end up spending years there if they have consecutive sentences or their trials are delayed. Walworth County Jail Superintendent Howard Sawyers said his county almost always has inmates who have passed the one-year mark, some staying two or three years.

Since 2003, 52 Wisconsin county jail inmates have taken their own lives. According to a Wisconsin Center for Investigative Journalism calculation, Wisconsin?s jail suicide rate in recent years was 40 per 100,000 inmates, slightly higher than the 2007 national rate of 36.

According to Dean Meyer, executive director of the Badger State Sheriff?s Association, state-run prisons are ?much better equipped? to provide health care.

?A prison has their own dentist, their own doctors and their own nurses. And for the majority of county jails, they contract that service out, and the providers only come when needed,? Meyer said.

Lawmakers may examine jails

Jails are required by a state law dating back to 1987 to provide the DOC with annual reports on mental health care services. Since 1989, the law has required the DOC to summarize and relay those findings to the Legislature. But the DOC acknowledges it has not been regularly asking jails for the reports, and has not prepared summaries for the Legislature, the Center found.

It?s been five years since the Baraboo News Republic newspaper pointed out that the reports weren?t being done. In 2007, DOC officials said they would address the shortcoming. This month, Dietz said her office ?is going to take another look at that statute.?

Bies and a fellow lawmaker, Sen. Kathleen Vinehout, D-Alma, said they are concerned about mental health care in jails, but lack the information to tackle the issue.

Vinehout, a member of the Senate Committee on Education and Corrections, said she couldn?t get information she wanted from the DOC about the types of inmates and the care they need. She believes the agency should strengthen its oversight of local jails to help inmates ??and the general public.

?We want to be able to understand what?s happening and do what we can to lower the cost and make Wisconsin a safer place,? Vinehout said.

Facebook's new Poke app sends self-destructing messages

We've heard rumors that Facebook's working on an app which will allow you to?send messages that'll self-destruct after being viewed???and on Friday the social network confirmed the whispers. The app's called Poke and it is now available to iOS users.

It's a bit odd that Facebook decided to name the new app after an annoying feature that's been around since 2004, but we won't fret about that oddity too long.?

Based on the explanation given in a post in Facebook's Newsroom, Poke is somewhat similar to Snapchat. Both apps allow you to send messages, photos or videos which will expire a specific amount of time after being viewed. (Though with Poke you've got the added ability to send ... a poke.)

When you communicate with a friend via Poke, you're able to?set a message to expire in 1, 3, 5?or 10 seconds. As soon as time runs out, the message will disappear. In order to view a message, you find it in the app and "press and hold the message until it expires."

Unlike Snapchat, Poke does not appear to notify users if a message?recipient takes a screenshot of the correspondence before it expires. In a way, this is good, because it doesn't give a false sense of security. On the other hand, some users might forget that someone can easily turn their temporary messages into something that'll haunt them permanently.

Poke is expected to hit the?Apple App Store on Friday afternoon. It'll work on iPhone, iPod Touch?and iPad. No word as to whether Android users will ever get in on the fun.

This story idea grabbed my attention: A husband claimed his wife hadn't cooked the same meal twice in nine years.

Goodness knows, I needed this cooking dynamo's advice. In the last month, I've "cooked" smoked sausage, Kraft mac-and-cheese and whatever vegetable was in the freezer at least three times. (In my defense, when I'm starving and dealing with a demanding toddler, the time it takes to cook macaroni is all the time I have.)

So I finagled an invitation for dinner at the Raleigh, N.C., home of Ned and Robin Mangum. Ned, now a Wake District Court judge, is an acquaintance from my years covering the Wake County, N.C., courthouse. He sent a note after a Facebook post about his wife's culinary record generated two dozen comments, such as: "Seriously?" "How is that even possible?" and "She has to stop making the rest of us look so bad!"

On the night I went for dinner, Robin said she wasn't aware of her tendency to avoid repetition until her husband pointed it out.

Robin, 38, has a degree in art education from Meredith College. She worked for two years at the Metropolitan Museum of Art in New York City. Now she works full time developing programs at Marbles Kids Museum in Raleigh. The couple has three boys: Robert, 8, who is called "Bear"; Gus, 4; and Hugh, 18 months. These days Robin said she no longer has time for painting, crafts or Martha Stewart-like projects.

As a result, she said, "I was putting all my creativity into dinner."

Robin doesn't claim to be a mother extraordinaire who makes every meal from scratch. At most, she cooks four nights a week. The family eats leftovers or dines out on the other evenings. When she does get to cook, it's relaxing. Ned takes the boys outside to play so she can get dinner ready. Or Gus, who is known as her "sous chef," will help in the kitchen.

She doesn't keep a food diary. And she does repeat the hits if requested or for a rare dinner party, but it's hard to resist reinvention.

On this recent Monday night meal, she has already made a vegetable stir-fry, which is being kept warm in the oven. She tweaked the dish, using white rice instead of her usual substitute, forbidden rice, a black grain that Bear calls "evil rice." She's chopping chives and red peppers for a pork filling for pot stickers, which she had never made before.

"It's been on the list to try," she said.

Robin keeps a list on her smartphone of dishes she wants to tackle: things she's eaten at restaurants or seen online. That's a starting point to look for recipes in cookbooks or on websites such as epicurious.com. She also looks for inspiration from her favorite Food Network stars Ina Garten and Ree Drummond, aka The Pioneer Woman.

In the summer, the family receives a box of vegetables each week from The Produce Box, a local company that offers delivery of produce from local farms. Those ingredients will lead Robin to search for something new to fix for the family.

Then there are the culinary tours that dinner occasionally becomes at the Mangum household. Robin has had the family eating their way through the British Isles, from shepherd's pie to bangers and mash. With seafood, she turns to the Greeks for inspiration.

There are sandwich nights, a run of slow-cooker recipes, or a series of chowders and soups. "The soup kick was good," Ned said.

On this night, Gus and Hugh add ketchup and Worcestershire sauce to the dumpling filling. Bear sets the table and then helps fill and seal the pot stickers, folding them into squares before his mom cooks them in a skillet.

As the family sits down to eat, Gus is asked to say grace, choosing the Pledge of Allegiance. The older boys have a special platter of the pot stickers they made set before them. Bear tastes the ones he made and the ones his mother made, declaring, "Mine are better than those."

Robin quips, "You have to have a thick skin in this family."

When I get up to leave, I have a full stomach, some dinner inspiration from a fellow working mom and a lesson in children as food critics.

HOMEMADE MCRIB SANDWICHES

This recipe is from Robin Mangum of Raleigh. About this recipe, Mangum wrote it is "so easy and perfect for a tailgate, Super Bowl party or a working mom feeding a family of big eaters." Mangum uses Sweet Baby Ray's barbecue sauce or the locally made Num Num Sauce. She urges others to get creative with the toppings. She has topped them with roasted kale chips.

2-3 racks of baby back ribs, cut into slabs of 3 or 4 ribs each

3 cups barbecue sauce

Sandwich buns

Pickle slices

White onion, thinly sliced

Place ribs in slow cooker and cover with barbecue sauce. Set on low and cook for 8 to 10 hours, basting every so often. Meat should be tender and falling off bone.

Pull rib bones out. Shred meat with two forks right in the slow cooker. If eating the next day, place in refrigerator to reheat later in slow cooker. (After it's chilled, fat will harden, making it easier to scrape it off the meat.) Or serve immediately.

Serve meat on toasted sandwich buns with pickles and onions.

Yield: 6-8 servings

Olympian Suzy Favor Hamilton says she has worked as escort

Three-time Olympian Suzy Favor Hamilton says she coped with depression and a troubled marriage by turning to a life of prostitution.

In a series of posts to her Twitter account, Favor Hamilton acknowledged working as an escort following a report Thursday on The Smoking Gun website about her double life.

"I do not expect people to understand," Favor Hamilton tweeted. "But the reasons for doing this made sense to me at the time and were very much related to depression."

The Smoking Gun said the 44-year-old athlete has been working for the last year for a Las Vegas escort service that booked her for dates there, as well as in Los Angeles, Houston and Chicago. The website said she charged $600 an hour for her services.

One of the country's best-ever middle-distance runners, Favor Hamilton competed for the U.S. at the Olympics in 1992, 1996 and 2000 but did not win a medal. She won seven U.S. national titles. She lives in Madison, Wis., where, The Smoking Gun reported, she and her husband, Mark, live in a $600,000 home and appear to be in no financial distress based on the website's review of court and municipal records.

Favor Hamilton told the website that only her husband was aware of her escort work, but that, "He tried, he tried to get me to stop. He wasn't supportive of this at all."

The website reported that Favor Hamilton worked under the alias "Kelly Lundy" but said she told some of her clients about her true identity and suspected one of them leaked it.

Soon after the story appeared online, Favor Hamilton released a series of tweets saying in part that she was "drawn to escorting in large part because it provided many coping mechanisms for me when I was going through a very challenging time with my marriage and my life."

A nine-time NCAA champion for Wisconsin, Favor Hamilton is the namesake of the Big Ten's Suzy Favor Athlete of the Year Award, given to the conference's top female athlete.

Neither Favor Hamilton nor officials from the Big Ten immediately responded to requests from The Associated Press seeking comment.

Prostitution is legal in most rural counties in Nevada, but is illegal in Las Vegas and Reno. A Las Vegas police spokeswoman did not immediately respond to a message about whether the department was investigating. Telephone numbers for the escort service Hamilton said she worked for were not in service and attempts to reach a company representative by email were not immediately successful.

Favor Hamilton is a three-time outdoor 1,500-meter national champion and a three-time indoor national champion ? her last title coming in 1999.

"As crazy as I know it seems, I never thought I would be exposed, therefore never hurting anybody," she said in one Twitter post.

In another, she says she is seeking psychological care for her problem.

She closes her series of tweets by saying, "I fully intend to make amends and get back to being a good mother, wife, daughter, and friend."

NRA: Video game industry 'sows violence against its own people'

After a week of intense anti-gun sentiment?following the shootings at Sandy Hook Elementary School, the National Rifle Association on Friday blamed?video games and their virtual guns?for creating a culture of violence that breeds killers.

"There exists in this country a callous, corrupt and corrupting shadow industry that sells, and sows, violence against its own people through vicious, violent video games with names like 'Bulletstorm,' 'Grand Theft Auto,' 'Mortal Kombat' and 'Splatterhouse,'" said?NRA?executive vice president Wayne LaPierre during a news conference that was interrupted by protesters. (See video above.)

While most of the games LaPierre listed are popular adult-themed games made by some of the biggest game companies in the world, the NRA chief?also called out a game called?"Kindergarten Killer" and asked why the media had ignored it.?

"How come my research department could find it and all of yours either couldn't or didn't want anyone to know you had found it?," he asked the press gathered in front of him.

If you know the name of the game, it's easy to find in a Web search, but it's not something someone is likely to stumble across.?That's because the simple, amateur Flash-animation game ? about a janitor who goes on a shooting spree in a school full of heavily armed children ? was posted in online forums a decade ago and?has never been for sale. There is no indication that the Newtown?shooter, 20-year-old?Adam Lanza, knew of its existence. Though a?Finnish site did remove the game after a shooting there, it is still available for free through other Flash sites.

LaPierre's accusations?come after lawmakers?and pundits earlier in the week?suggested that video games had played a role in the Newtown shootings. Though some reports suggest Lanza?played video games ranging from the family-friendly "Mario Party" to the violent "Call of Duty," investigators have yet to make any such connection.

While a new Gallup poll suggests that 47 percent of?Americans do think reducing gun violence in movies, TV and video games would be "very effective" in preventing mass shooting at schools,?researchers?and adolescent?psychiatrists have?spoken out this week, insisting?that the link between digital violence and real world violence is tenuous at best.?

"There is no good evidence that video games or other media contributes, even in a small way, to mass homicides or any other violence among youth," wrote?Chris Ferguson???professor of psychology and criminal justice at Texas A&M University and author of several studies on the subject,?in Time Magazine.

Meanwhile, in the wake of the real-world bloodshed, some gamers have called on their fellow players to take the time to examine their fascination with digital guns and violence.

(AP) ? The nation's largest gun-rights lobby called Friday for armed police officers to be posted in every American school to stop the next killer "waiting in the wings."

The National Rifle Association broke its silence on last week's shooting rampage at a Connecticut elementary school that left 26 children and staff dead.

"The only thing that stops a bad guy with a gun is a good guy with a gun," the group's top lobbyist, Wayne LaPierre, said at a Washington news conference.

LaPierre said "the next Adam Lanza," the man responsible for last week's mayhem, is planning an attack on another school.

"How many more copycats are waiting in the wings for their moment of fame from a national media machine that rewards them with wall-to-wall attention and a sense of identity that they crave, while provoking others to try to make their mark," LaPierre said. "A dozen more killers, a hundred more? How can we possibly even guess how many, given our nation's refusal to create an active national database of the mentally ill?"

He blamed video games, movies and music videos for exposing children to a violent culture day in and day out. "In a race to the bottom, many conglomerates compete with one another to shock, violate, and offend every standard of civilized society, by bringing an even more toxic mix of reckless behavior and criminal cruelty right into our homes," LaPierre said.

He refused to take any questions after speaking. Though security was tight, two protesters were able to interrupt LaPierre's speech, holding up signs that blamed the NRA for killing children. Both were escorted out, shouting that guns in schools are not the answer.

LaPierre announced that former Rep. Asa Hutchison, R-Ark., will lead an NRA program that will develop a model security plan for schools that relies on armed volunteers.

The 4.3 million-member NRA largely disappeared from public debate after the shootings in Newtown, Conn., choosing atypical silence as a strategy as the nation sought answers after the rampage. The NRA temporarily took down its Facebook page and kept quiet on Twitter.

Since the slayings, President Barack Obama has demanded "real action, right now" against U.S. gun violence and called on the NRA to join the effort. Moving quickly after several congressional gun-rights supporters said they would consider new legislation to control firearms, the president said this week he wants proposals to reduce gun violence that he can take to Congress by January.

Obama has already asked Congress to reinstate an assault weapons ban that expired in 2004 and pass legislation that would stop people from purchasing firearms from private sellers without a background check. Obama also has indicated he wants Congress to pursue the possibility of limiting high-capacity magazines.

Oregon Ducks Will Face NCAA Committee of Infractions Hearing This Spring

Attempts by Oregon to resolve the Will Lyles case by summary disposition has failed, and the school will face a hearing before the Committee of Infractions.

Bad news from Charles Robinson of Yahoo! Sports, who is reporting that attempts by the University of Oregon to get a summary disposition in the Will Lyles case has failed, and that the school will face a hearing before the NCAA Committee of Infractions this spring. Oregon had hoped to get a summary disposition, essentially copping to an agreed-upon version of violations and penalties, but the two sides were unable to come to an agreement on exactly what violations occurred and what penalties were appropriate.

According to Robinson, one sticking point seems to be who was to blame for the lack of physical scouting reports. Oregon claims that they received oral reports, and that Lyles is at fault for not providing written reports. The NCAA disagreed with that assessment. Additionally, four other charges have been redacted in public reports. Other known charges against Oregon are failure to monitor use of scouting services, and having an extra coach on the recruiting trail.

This is not good news for Oregon, as a summary disposition would have ended the case. Given the two sides' inability to agree on proposed infractions and consequences, it certainly has to make Duck fans more nervous that serious sanctions could occur. The Committee on Infractions is highly unpredictable.

So for now, Oregon fans await our fate, and things should be resolved one way or another this summer.

"The House I Live In" leaves you shaking your head in deadened wonder at the waste of it all.

The House I Live In is a work of journalism, not propaganda: Jarecki has done his research and leaves it to you to decide what to make of it.

If [it] takes a while to focus, it eventually becomes the conversation starter the subject desperately needs.

Jarecki takes a highly original approach to create a compelling, thought-provoking look at a highly relevant and controversial topic.

An absorbing, disturbing sit.

It's a film as profoundly sad as it is enraging and potentially galvanizing, and it's one of the most important pieces of nonfiction to hit the screen in years.

Jarecki's arguments, presented as a very personal response to the war on drugs, are unashamedly those of a left-wing libertarian. They are also enormously compelling and extremely convincing.

Suffused with a righteous anger that Jarecki methodically turns up to full boil, The House I Live In is an emotionally shattering work, but also one with a hefty, legitimate intellectual punching power.

The ambitious look at the drug problem here offers a too simplistic view that demands a more critical and more inclusive look.

What this film argues, pretty convincingly, is that the war on drugs is much worse than a failure. It argues that it is tearing our society apart.

Jarecki makes clear that all our efforts and investments in fighting the War on Drugs haven't yielded any real success, only ruined lives, families and communities. There comes a point in any war where it becomes important to ask: Is it worth it?

Invasive plant species may harm native grasslands by changing soil composition

Dec. 18, 2012 ? The future landscape of the American Midwest could look a lot like the past -- covered in native grasslands rather than agricultural crops. This is not a return to the past, however, but a future that could depend on grasslands for biofuels, grazing systems, carbon sequestration, and other ecosystem services. A major threat to this ecosystem is an old one -- weeds and their influence on the soil.

According to a study in the journal Invasive Plant Science and Management, when invasive plants spread, they can leave behind a "legacy" of alteration in the native soil. Even after an invading species has been controlled, its effects can inhibit the regrowth of native plant species. The causes of this process are still being investigated and may involve changes in soil food webs, soil microbial communities, and mutualistic fungi.

In the study, researchers tested soil conditions for changes in composition after three growth cycles of invasive plant species. Researchers looked for changes in colonization rates, diversity, and composition of arbuscular-mycorrhizal fungi (AMF). Three exotic plant species -- crested wheatgrass, smooth brome, and leafy spurge -- were tested in a glasshouse experiment. These plants, all characterized as strong invaders, were grown in native soil collected from North Dakota grasslands. Native species, including western wheatgrass, little bluestem, and blue gramma, were also grown, and after three growth cycles, soil composition was compared among these treatments.

The findings of this study showed that (1) invasive species changed the composition of AMF communities in seedling roots of native grassland species, and (2) invasive species were less colonized by AMF, forming fewer associations than native grassland species. These findings suggest that the ecological differences in how these native and invasive plants interact with soil may be a factor in this legacy effect. While market and policy demands might lead to a native grasslands agro-ecosystem, invasive plants species could derail its establishment. Weed management must be a component of any such ecosystem, so that it is possible to establish grasslands that are useful and profitable.

Distressed homeowners need caution | Inside Real Estate News

If you were the victim of a mortgage-?or housing-related fraud in the past year, you are not alone.

The FBI recently announced that its year-long Distressed Homeowner Initiative involved more than 73,000 victims suffering more than $1 billion in losses. The good news is that 530 alleged scammers were charged with criminal offenses.

Many of these crimes have similar characteristics:

  • The perpetrators ask you to pay a fee in exchange for a guarantee that they can modify or cancel your delinquent loan. No one can guarantee such results as the final decisions are made ultimately by your lender.
  • The perpetrators pressure you to sign papers immediately or try to convince you that they can ?save? your home if you sign or transfer the deed to your house. Signing over your deed leaves you with no home and still on the hook for your debt.
  • The perpetrators have you sign confusing paperwork that transfers your property to them or some third party, unaffiliated with your lender. Never sign a deed or grant a power of attorney to your property to any organization or individual unless you can confirm that they are working directly with your mortgage company to forgive your debt. While it is difficult to sometimes even identify who your lender is, it is critical that you only deal directly with your lender or its current service provider.
  • The perpetrators often insist on making your mortgage payments directly to your lender. You should never allow anyone else to make your mortgage payments nor should you ever make payments to anyone other than your current lender.

These scams and schemes are quite easily accomplished for several reasons: First, there is an enormous amount of publicly available information on homeowners and their loans. Deeds of trust or mortgages are public record. Second, credit-reporting bureaus make millions by selling loan data. Third, notices of foreclosures are filed publicly and available online and in all courthouses. Fourth, legal notices of foreclosure auctions are published daily in local newspapers. These due process requirements provide scammers with a steady stream of distressed homeowner leads and a bounty of personal data about their delinquent loans.

Also, loan documentation is exceedingly complex and voluminous, typical settlement documentation runs approximately 100 pages of legalese. These factors, among others, make the loan process easily manipulated for fraudulent purposes. For example, legitimate deeds of trust contain a granting clause that provides that the borrower ?grant? all rights to his home to a ?trustee? for the lender?s benefit. Buried elsewhere in the legitimate deed of trust are clauses that say that the trustee cannot exercise any possessory rights to the home, unless the borrower is in default. These legitimate clauses look very similar to clauses used to perpetrate frauds on the borrowing public.

One of the most popular scams, victimizes homeowners who think that they are refinancing. The ?diguised sale? scam occurs when the homeowner, thinking he is refinancing, signs paperwork at settlement that is not a loan at all but a conveyance to a third-party, co-conspirator, buyer. From his perspective, it looks just like a loan transaction, except buried somewhere in the settlement paperwork is language deeding his property. His original mortgage gets paid off. What he does not realize is that he no longer owns his home.

Using a bogus purchase contract and seemingly valid deed, the fraudulent buyer borrows the maximum amount possible, based on the home?s appraised value. The fraudulent buyer then uses these funds to pay off the homeowner?s existing liens and pockets the rest. The perpetrator may initially make a few months? mortgage payments. However, he will eventually stop making any mortgage payments. Adding insult to injury, he will continue to collect mortgage payments from the homeowner who continues to live in the home unaware that he is in fact merely a ?renter.? Ultimately, the resident discovers that he no longer owns his home when he receives an eviction notice from the perpetrator?s bank that has foreclosed.

Even when the resident discovers what happened, the perpetrator?s bank will not acknowledge him, provide him with any information or negotiate with him. On paper, he is not the owner or the borrower. Privacy laws prevent lenders from discussing any loans with anyone except its borrower or the borrower?s authorized agent.

Another common scheme called ?equity stripping? victimizes distressed homeowners who have equity in their homes but not the monthly income to justify conventional refinancing.

Equity stripping schemes often start with predatory lenders contacting homeowners to inform them that they have been ?pre-qualified? for loans that seemingly will allow them to refinance their existing debt at very favorable terms. The way these predatory lenders ?qualify? these homeowners is by falsifying loan applications. False applications are prepared using inflated income via forged or doctored earnings statements, fake employment verifications and manufactured bank account statements.

Not coincidently, the loan fees for these cash-out loans are steep, often equal to the cash-out loan proceeds. Other times, the fraudulent lender keeps all the loan proceeds by claiming that the homeowner must establish escrow accounts. Those funds are never placed into an escrow. They are diverted to the scammer and the homeowner never sees those funds or receives any benefit from them. When the dust settles, the homeowner has a mortgage that he cannot afford and will likely face foreclosure on loan larger than when he started.
